Schedule of Condition

A lease will typically contain obligations upon a tenant to look after a property in a specified manner. These are referred to as repairing covenants and upon assignment or at the end of the lease a landlord may refer to them to confirm whether they have been complied with.

A schedule of condition is a written and photographic record of the condition of the property which is prepared prior to the commencement of the lease which provides a tenant with protection from a claim by the landlord that the covenants to keep the premises in good repair have not been complied with.

Schedule of Dilapidations

A schedule of dilapidations may be prepared either during or at the end of a lease, usually on behalf of the landlord, and is a written and photographic record of the state of repair of a property.

The report details whether the tenant has complied with covenants within the lease to look after the property and if not the cost of putting the property back into a good state of repair.

Party Wall Awards

If you are planning alteration or extension works to your premises that might affect your neighbour’s property you will need to obtain their consent or alternatively a legal agreement known as a Party Wall Award to do so.
Examples of works that may fall into this category include:

• Extensions
• Inserting load bearing beams into party walls
• Basement conversions
